Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
· Entrepreneur: The natural or legal person who offers products and/or services to consumers via the website www.flourishmystyle.com
· Consumer: The natural person who is not acting for purposes related to their trade, business, craft, or profession and who enters into an agreement with the entrepreneur.
· Services: Digital styling advice for bathroom interiors.
· Products: Physical bathroom items such as toilet paper holders, shower curtains, bath mats, etc.
Article 2 – Applicability
1. These general terms and conditions apply to every offer from the entrepreneur and every agreement concluded between the entrepreneur and the consumer.
2. By placing an order, the consumer agrees to these terms and conditions.
Article 3 – The Offer
1. The offer includes a complete and accurate description of the offered products and services.
2. Obvious mistakes or errors in the offer do not bind the entrepreneur.
3. All offers are valid while stocks last. If a product is no longer available after the order has been placed, the entrepreneur will inform the consumer as soon as possible and, if applicable, offer an alternative or refund the payment.
Article 4 – The Agreement
1. The agreement is concluded at the moment the consumer accepts the offer and meets the associated conditions.
2. The entrepreneur confirms receipt of the order by email.
Article 5 – Right of Withdrawal
1. The customer has 14 days to withdraw from the purchase (notify of a return).
2. After this notification, the customer has another 14 days to actually return the product.
3. The refund must be issued within 14 days after the return notification.
Article 6 – Delivery and Execution
1. The entrepreneur will exercise the greatest possible care in receiving and fulfilling product orders.
2. Delivery time for products is typically 5–15 business days.
3. Styling advice will be delivered digitally within 5 business days after the completed intake form is received.
Article 7 – Prices and Payment
1. All listed prices include VAT and exclude shipping costs (unless otherwise stated).
2. Payment is made via the payment methods offered in the webshop.
Article 8 – Liability
1. The entrepreneur is not liable for damage resulting from the misuse of delivered products.
2. The entrepreneur is not liable if the styling advice does not match the consumer’s personal taste or the technical limitations of their living space.
Article 9 – Complaints Procedure
1. Sometimes things may not go as planned. We recommend that you first report any complaints about the execution of the agreement clearly and fully within 7 days of delivery to: flourishmystyle@gmail.com
2. The entrepreneur aims to respond to complaints within 5 business days.
3. If this does not lead to a solution, it is possible to submit your dispute for mediation via WebwinkelKeur at: https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil
Article 10 – Applicable Law
1. Dutch law exclusively applies to agreements between the entrepreneur and the consumer.
2. Disputes will preferably be resolved in mutual consultation. If this is not possible, the dispute may be submitted to the competent Dutch court.
Article 11 – Damages and Issues
If you make use of your right of withdrawal, the product must be returned to the entrepreneur with all supplied accessories and – if reasonably possible – in its original condition and packaging.
If the product is damaged or the packaging is more damaged than necessary to assess or sell the product, we may charge you for any depreciation in value. Therefore, please handle the product with care and ensure it is properly packaged when returned.
To exercise this right, you can contact us at flourishmystyle@gmail.com. We will refund the order amount due within 14 days after your return has been registered, provided that the product has been received in good condition.
